إجراءات تضمين الموظف العام

إدراج نظام خاص يهدف المشروع من خلاله إلى تحقيق هدفين. الأول هو إزالة الضرر الذي يلحق بالمال العام من قبل الموظف أو المكلف بالخدمة العامة. الثاني: حماية المال العام من الأذى بردع الموظف والآخرين عن أي ضرر يحدث ، فتتضح أهمية هذه الدراسة من خلال لمستها في موضوع مهم وحساس ومتكرر في الوقت الحاضر وهو الاعتداء المتكرر على المال العام ، وضرورة العمل على إزالة الضرر أو إصلاحه بعد وقوعه ، والبحث عن الجاني والتحقيق معه بعد السماح لي بالدفاع عن نفسه. بالنسبة لبعض العاملين في الحكومة ، أصبح شغل المناصب العامة وسيلة لمتابعة المصالح الشخصية غير المشروعة ، على الرغم من أن المشرع منح الإدارة سلطة حماية أموال دافعي الضرائب. يمكن تحديد مسؤولية الموظف ومقدار الإدماج دون اللجوء إلى السلطة القضائية ، وذلك بفضل السلطة الإدارية في إدراج الحقوق التي يمنحها لها المشرع (المحكمة). لقد أوضحنا في هيئة الدراسة أنه يجوز للإدارة تحصيل دفعة التضمين دفعة واحدة أو على أقساط ، ويمكنها استخدام الوسائل القانونية إذا رفض الموظف الدفع.
