التفاقم السلبي للنصوص القانونية في القانون المدني العراقي

تعاني القواعد القانونية في التشريع العراقي في كثير من نصوصه من عيوب في الصياغة التشريعية والصياغة القانونية الجيدة. وهذا بدوره يشكل عقبات أمام الباحثين عند دراسة وتحليل النصوص والقواعد القانونية في التشريع العراقي ، مما يترك حالة من الالتباس عند وضع هذه النصوص موضع التنفيذ. بالإضافة إلى ذلك ، فإن هذا يترك موقفًا يكون فيه عدم الوضوح عند وضع هذه النصوص موضع التنفيذ. لذلك ، يهدف هذا البحث إلى دراسة وتحليل القواعد القانونية الموجودة في التشريع العراقي لتشخيص النصوص المتناقضة والمتكررة والاستثناءات التي تسود على الأصل ، وكذلك التعرف على النصوص غير المبررة للتوصل إلى حلول عملية لهذه القضية.
